Terms of Service - BidVision

These Terms of Service ("Terms") govern your access to and use of the BidVision website, applications, and related services (the "Service"). By accessing or using the Service, you agree to these Terms.

BidVision is currently a pre-launch service operated from Lithuania. If BidVision later begins operating through a registered legal entity, these Terms will be updated with the full legal entity name and registration details.

1. The Service

BidVision provides software tools designed to help users review publicly accessible vehicle auction listings, estimate vehicle damage using AI-assisted analysis, estimate import-related costs, and manage related bidding workflows.

BidVision is a decision-support tool. It does not act as a vehicle inspector, broker, insurer, customs adviser, tax adviser, financial adviser, or legal adviser.

2. Eligibility and account access

You may use the Service only if you can form a binding agreement under applicable law and are authorized to use the account you log in with.

Access to BidVision may be limited, including through allowlisted Google account email addresses. You are responsible for maintaining the security of your account and for all activity occurring under your account unless caused by our failure to use reasonable security measures.

3. Acceptable use

You agree not to:

use the Service for unlawful, fraudulent, or misleading purposes;
attempt to gain unauthorized access to the Service, other accounts, or related systems;
interfere with or disrupt the integrity, security, or performance of the Service;
copy, reverse engineer, resell, sublicense, or exploit the Service except as allowed by law or with our written permission;
use the Service in a way that infringes third-party rights, including intellectual property or privacy rights; or
submit malicious code, abusive automated traffic, or data that you do not have the right to submit for processing.

4. User inputs and permissions

You are responsible for the data, URLs, and other materials you submit to the Service. You represent that you have the necessary rights and lawful basis to submit that information and request its processing.

To operate the Service, you grant BidVision a limited, non-exclusive, revocable right to store, process, reproduce, and analyze your submitted data for the purposes of providing the Service, maintaining security, troubleshooting, and improving service quality.

5. Credits, pricing, and payments

Some features of the Service may require credits or paid access. Credit packs, prices, included usage, and availability may change over time. Current pricing is shown in the Service at the time of purchase.

Credits are for use within the Service only.
Credits are not transferable between users unless we explicitly allow it.
Credits have no cash value except where required by applicable law.
Payments are processed by third-party providers such as Stripe.
We do not store full payment card details on our own systems.

Unless otherwise required by applicable law, completed purchases of credit packs are generally non-refundable once credits have been made available to your account. This does not limit any mandatory consumer rights you may have under applicable law, including rights relating to faulty digital services or unauthorized transactions.

6. Third-party services and data sources

The Service may interact with or rely on third-party providers and data sources, including Google, Stripe, AI model providers, auction listing websites, and market-value or parts-price sources. We do not control those third-party services, websites, or data sources, and we are not responsible for their independent availability, terms, or privacy practices.

7. AI analysis disclaimer

Vehicle damage analysis, repair estimates, cost calculations, and market value outputs provided by BidVision are estimates only. AI and automated methods can be incomplete, inaccurate, or outdated.

You must independently verify vehicle condition, title status, repair costs, taxes, duties, shipping charges, fees, legal compliance, and other transaction-critical facts before bidding, purchasing, importing, or relying on any output.

BidVision does not guarantee that a vehicle is free from hidden damage, structural issues, fraud, or unforeseen costs.

8. Beta nature and service changes

BidVision may still be in beta or pre-launch form. Features may change, evolve, be interrupted, or be removed. We may modify, suspend, or discontinue all or part of the Service at any time, including to improve security, comply with legal requirements, or update product direction.

9. Intellectual property

The Service, including its software, design, branding, text, structure, and original content, is owned by BidVision or its licensors and is protected by applicable intellectual property laws.

These Terms do not transfer ownership of the Service or any BidVision intellectual property to you. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose.

10. Suspension and termination

We may suspend or restrict access to the Service if we reasonably believe you have violated these Terms, used the Service unlawfully, created a security risk, or exposed BidVision or others to legal or operational harm.

You may stop using the Service at any time. Where required by law or reasonably practical, we will try to preserve access to account data for a reasonable period before permanent deletion, subject to our retention and legal obligations.

11. Consumer rights

Nothing in these Terms excludes or limits any mandatory rights you may have under applicable consumer protection law. If you are a consumer in the European Union, you may benefit from mandatory protections of the country where you habitually reside.

Any contract term that would be unenforceable under mandatory law will be interpreted or limited to the minimum extent necessary, and the remainder of these Terms will continue to apply.

12. Warranties disclaimer

To the maximum extent permitted by applicable law, and without limiting any mandatory consumer rights, the Service is provided on an "as is" and "as available" basis. We do not make guarantees that the Service will be uninterrupted, error-free, fully accurate, or suitable for every intended use.

13. Limitation of liability

To the maximum extent permitted by applicable law, and without limiting mandatory consumer protections, BidVision will not be liable for indirect, incidental, special, consequential, or purely economic losses, including lost profits, lost opportunities, business interruption, data loss, or purchase decisions based on incomplete or inaccurate analysis results.

To the maximum extent permitted by applicable law, BidVision's total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of:

the amount you paid to BidVision for the Service in the 12 months before the event giving rise to the claim; or
EUR 100, if you have not made any paid purchase.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, death or personal injury caused by negligence where such liability cannot lawfully be excluded, or any other liability that cannot be limited under applicable law.

14. Privacy

Our processing of personal data is described in our Privacy Policy. By using the Service, you acknowledge that we may process personal data as described there.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice through the Service.

Your continued use of the Service after updated Terms become effective means you accept the updated Terms, unless mandatory law requires a different process.

16. Governing law and disputes

These Terms are governed by the laws of Lithuania, except to the extent that mandatory consumer protection law in your country of residence provides otherwise.

If a dispute arises, we encourage you to contact us first so we can try to resolve it informally. If you are a consumer, you may also be entitled to bring claims in the courts of your place of residence or use other remedies available under applicable law.
